Immigration, Refugees, and Citizenship Canada (IRCC) has introduced a temporary policy allowing certain Provincial Nominee Program (PNP) candidates to apply for an Open Work Permit (OWP).

Under this new policy, eligible newcomers can obtain an OWP if they have a job offer, hold a valid work permit, or if their work permit expired on or after May 7th. They must also present a support letter from the province or territory where they reside, confirming their placement in an Expression of Interest pool or similar application process.

Effective from August 11, 2024, this policy will remain in place until December 31, 2024, although IRCC warns that it could be revoked without prior notice.

Who is eligible under this policy?
Certain PNP candidates may qualify for an OWP under the following scenarios:

Scenario 1: The candidate currently holds a valid work permit. To be eligible, the candidate must:

Have applied for a new work permit under section 200 of the Immigration and Refugee Protection Regulations (IRPR).
Provide:
A support letter from the relevant provincial or territorial authority confirming their placement in an Expression of Interest pool or application inventory.
A letter of employment from their current employer.

Scenario 2: The candidate held a valid work permit on May 7, 2024, which has since expired. To be eligible, the candidate must:

Have applied for:
A new work permit under section 200 of the IRPR.
An extension of their temporary resident status under section 181 or restoration of status under section 182.
Provide:
A support letter from the relevant provincial or territorial authority.
A letter of employment from their current employer.

Scenario 3: The candidate was authorized to work under paragraph 186 (u) of the IRPR on May 7, 2024, and their Work Permit extension is pending or approved. To be eligible, the candidate must:

Have applied for:
A new work permit under section 200 of the IRPR.
An extension of their temporary resident status under section 181.
Provide:
A support letter from the relevant provincial or territorial authority.
A letter of employment from their current employer.

The IRCC aims to balance the number of temporary and permanent residents in Canada by helping provinces transition eligible temporary residents through PNPs. Many of these candidates are already contributing to the economy, and this policy helps them transition to permanent residency, ensuring that skilled workers remain in the country to address labor market needs.
